2. ACCEPTANCE OF TERMS

By accessing and using this website, you agree to be bound by these Terms and Conditions in accordance with Spanish and European legislation.
If you do not agree with any part of these terms, you must immediately discontinue use of the website and its products.

3. INTELLECTUAL PROPERTY

All plugins, source code, designs, logos, and content developed by Talariasoft are protected under Spanish Intellectual Property Law (Royal Legislative Decree 1/1996) and may not be distributed, modified, or resold without prior written authorization.

3.2. Prohibition of copying and reverse engineering

Any total or partial copying, distribution, modification, decompilation, reverse engineering, or other unauthorized use of the source code, structure, algorithms, or functionalities of Talariasoft plugins is strictly prohibited, whether carried out by automated or manual means.

This prohibition includes, but is not limited to:

  • Extraction of code for reuse in other projects
  • Creation of derivative plugins that fully or partially replicate Talariasoft functionalities
  • Use of the code in competing systems or for unauthorized commercial purposes

This protection applies to both visible and underlying code, including but not limited to business logic, interfaces, databases, and integrated AI systems, in accordance with Directive 2009/24/EC on the legal protection of computer programs and Spanish Patent Law 24/2015.

Any breach of this clause may result in immediate license termination, legal action for intellectual property infringement, and claims for damages in accordance with Article 270 of the Spanish Criminal Code.

4. LICENSE OF USE

  • Plugins are distributed under the GPL v3 license or later
  • Each purchase includes a license for use on one website (single domain)
  • Updates and technical support are provided for 12 months, renewable

5. PAYMENT AND REFUND POLICY

  • Prices are listed in EUR (€) and include applicable VAT in Spain (21%)
  • Right of withdrawal: 14 calendar days from the date of purchase, in accordance with Royal Legislative Decree 1/2007
  • Refunds apply only if the plugin contains irreparable technical defects not caused by the user

6. LIMITATION OF LIABILITY

Talariasoft shall not be held liable for:

  • Indirect damages or data loss resulting from the use of the plugins
  • Incompatibilities with outdated WordPress versions or third-party components
  • Modifications made by the user to the source code

7. DATA PROTECTION (GDPR / LOPDGDD)

Personal data is collected and processed in accordance with our Legal Notice and Privacy Policy, in compliance with:

  • Regulation (EU) 2016/679 (GDPR)
  • Spanish Organic Law 3/2018 (LOPDGDD)

Users may exercise their rights (access, rectification, erasure) by contacting info@talariasoft.com.

8. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Spanish law.
Any dispute shall be submitted to the Courts and Tribunals of Zaragoza (Spain), with express waiver of any other jurisdiction.

9. MODIFICATIONS

Talariasoft reserves the right to modify these Terms and Conditions at any time.
